Terms of Service

1. Acceptance of Terms
By accessing or using the EB-CASE platform ("Platform"), including the web backoffice, mobile application, and all associated services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
These Terms apply to all users: Law Offices (attorneys, paralegals, attendants, admins) and End Users (immigration clients).
2. Description of Service
EB-CASE provides a white-label SaaS platform for immigration law offices that includes:
- AI-powered case pre-screening and document analysis tools
- Secure document upload, storage, and management
- Scheduling and video consultation booking
- Payment processing via Stripe Connect
- Attorney-client communication (encrypted chat)
- Immigration case tracking and progress management
- Backoffice management tools for law offices
3. Not Legal Advice
The EB-CASE platform, including all AI-generated content, does NOT constitute legal advice.
AI pre-screening results, visa recommendations, and case analysis are informational tools only. They are provided to assist licensed immigration attorneys in their work, not to replace legal judgment. No attorney-client relationship is formed with EB-CASE by using the Platform.
Any legal advice you receive comes solely from the licensed attorney(s) at the Law Office you engage through the Platform. EB-CASE is not responsible for legal outcomes.
4. User Accounts & Eligibility
4.1 Eligibility
You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement and that all information you provide is accurate and current.
4.2 Account Security
You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately of any unauthorized access at security@eb-case.com. We are not liable for losses caused by unauthorized use of your account.
4.3 Attorney Accounts
Attorney and staff accounts require Multi-Factor Authentication (MFA). Attorneys are responsible for ensuring their team members comply with these Terms and applicable professional conduct rules (including attorney-client privilege obligations).
5. Acceptable Use
You agree NOT to:
- Submit false, misleading, or fraudulent information
- Attempt to reverse-engineer, scrape, or extract data from the Platform
- Use the Platform for any purpose that violates US immigration law or any applicable law
- Attempt to gain unauthorized access to other users' data
- Upload malware, viruses, or malicious code
- Harass, threaten, or harm other users
- Use the AI features to generate fraudulent immigration documents or misrepresentations
- Share access credentials with unauthorized parties
6. Attorney-Client Relationship & Privilege
When a client engages a Law Office through the Platform, an attorney-client relationship is formed exclusively between the client and the Law Office — not with EB-CASE. All privileged communications occur within the Law Office's tenant environment.
By accepting the specific attorney-client privilege consent during onboarding, you acknowledge that:
- You are seeking legal counsel from a licensed immigration attorney
- Your communications are confidential and subject to attorney-client privilege
- The attorney represents your legal interests
- Digital acceptance constitutes legally binding consent
7. Biometric Data Consent
If you consent to facial recognition for identity verification, you acknowledge and agree:
- Your biometric data (facial template hash) is collected solely for identity verification
- Only a mathematical hash is stored — not your image or raw biometric data
- Biometric data is automatically destroyed 30 days after verification
- Your biometric data will never be sold or used for any other purpose
- You may revoke consent at any time (an alternative verification method will be offered)
- This consent complies with BIPA (Illinois), CCPA/CPRA (California), and similar state laws
8. Payments & Refunds
8.1 Payment Processing
All payments are processed through Stripe (PCI-DSS compliant). By making a payment, you agree to Stripe's Terms of Service. Law Offices receive payments via Stripe Connect with an automatic platform fee.
8.2 Refund Policy
For consultation appointments:
- Cancellation >24 hours before: 100% refund
- Cancellation <24 hours before: 50% refund
- Attorney-initiated cancellation: 100% refund + service credit
- No-show by client: No refund
9. Intellectual Property
EB-CASE retains all rights to the Platform, software, AI models, and associated intellectual property. You retain ownership of all content you upload (documents, narratives, etc.). By uploading content, you grant EB-CASE a limited license to process it solely to provide the Platform services.
AI-generated analysis outputs are provided as tools for the assigned attorney. They do not constitute original copyrightable works of EB-CASE.
10. Disclaimers & Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. EB-CASE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI ANALYSIS WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EB-CASE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE USE OF THE PLATFORM SHALL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR IMMIGRATION OUTCOMES, LEGAL DECISIONS, OR RESULTS OF VISA APPLICATIONS.
11. Indemnification
You agree to indemnify and hold harmless EB-CASE, its officers, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from your violation of these Terms, your use of the Platform, or your violation of any applicable law.
12. Termination
We may suspend or terminate your account for violation of these Terms, fraudulent activity, or conduct that harms other users or the Platform. You may terminate your account at any time through Settings → Account → Delete Account. Upon termination, your data is handled per our Privacy Policy and applicable legal retention requirements.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules, except for injunctive relief claims which may be brought in Delaware state or federal courts.
Class action waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Changes to Terms
We may update these Terms at any time. We will notify you via email and in-app notification at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance of the new Terms.
